Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody

Courtroom proceedings

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to answer human smuggling allegations, he was detained in immigration custody.

In her decision, the court pointed out that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal challenge involve disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.

Terms of Release

The judge, who was hearing his challenge to removal in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This decision shifts his supervision to the Tennessee court.

This ruling represents a notable development in a complex legal case involving allegations of mistaken imprisonment and contested gang affiliations.
